Creditor Investigation Date (General Date)
The creditor investigation date is a meeting held to examine the existence, amount, cause, and priority of each claim reported by bankruptcy creditors, with the participation of the bankruptcy trustee, other bankruptcy creditors, and the debtor corporation (Article 451 and Article 453 of the Debtor Rehabilitation and Bankruptcy Act).
Preparation for Creditor Investigation Date
In practice, the bankruptcy trustee submits a bankruptcy creditor objection list to the court before the creditor investigation date, stating whether each reported claim is acknowledged or disputed. During the creditor investigation date, the bankruptcy trustee presents the results of the claim investigation (acknowledged or disputed) in accordance with the content of the creditor objection list.
Investigation of Claims
Claims reported before the creditor investigation date, as well as those reported afterward, will be investigated during the general creditor investigation date if no objections are raised. Claims reported after the general date will be investigated during a special investigation date.
Confirmation of Claims
If the bankruptcy trustee or creditors raise an objection during the investigation date, the claim will not be confirmed immediately and will require a separate confirmation procedure. However, if no objections are raised, the claim is immediately confirmed, and the result is recorded in the bankruptcy creditors' list, having the same effect as a final judgment for all bankruptcy creditors. As a note, the Seoul Rehabilitation Court and Suwon Rehabilitation Court implement a fast-track procedure that skips the creditor investigation procedure in cases where it is clearly expected that the case will result in a dismissal without distribution to creditors.
